PVTIME – The European Commission has opened infringement proceedings against 26 EU member states for failing to transpose Directive (EU) 2024/1788, also known as the Hydrogen and Decarbonised Gas Directive, into national law.

On 25 September 2026, the Commission confirmed that it had sent formal notice letters to the non-compliant countries, giving them two months to respond and complete the transposition. If these responses are deemed unsatisfactory, the Commission may issue a reasoned opinion and ultimately refer the cases to the Court of Justice of the European Union.
Italy is the only member state to have fully transposed the directive by the deadline. Formal notices were sent to Belgium, Bulgaria, the Czech Republic, Denmark, Germany, Estonia, Ireland, Greece, Spain, France, Croatia, Cyprus, Latvia, Lithuania, Luxembourg, Hungary, Malta, the Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland and Sweden.
Adopted in 2024 as part of the EU’s hydrogen and decarbonised gas package, the directive updates the rules governing the EU natural gas market and introduces a regulatory framework for dedicated hydrogen infrastructure. The aim is to facilitate the integration of renewable and low-carbon gases, including hydrogen, while maintaining security of supply and energy affordability.
